Federal vs. Unitary States

Decentralization exists in both kinds of state. The deeper constitutional question is whether regional authority is independently protected or ultimately delegated by the center.

FEDERAL

Two constitutional orders share authority.

NationalRegional

In federations, education authority is often substantially regional or shared, although national governments may influence funding, rights, standards, or higher education.

Key idea: constitutionally divided authority
UNITARY

Ultimate constitutional authority remains national.

NationalDevolved / local

In unitary states, parliament or the national government ultimately holds constitutional authority, even when education is administered by devolved or local bodies.

Key idea: delegated or devolved authority

Do not confuse federalism with decentralization. A unitary state can be highly decentralized, while a federation can centralize substantial policy authority. The constitutional source and durability of regional power is the key distinction.

Three tests reveal where power really sits.

Can the center abolish the region’s powers?

If yes through ordinary national law, the arrangement is more characteristically unitary or devolved.

Do regions participate in national rule?

Many federations connect regional self-rule with shared rule through a second chamber or intergovernmental institutions.

Who resolves jurisdictional conflict?

Constitutions and courts often define the boundary when different levels claim authority over the same issue.
